While drivers in Florida have a responsibility to operate their vehicles in a safe manner, Florida is no stranger to distracted or dangerous drivers. These pose a serious threat to bicyclists trying to cross the road or otherwise utilize our streets. In 2016 alone, there were over 6,500 injuries to bicycle-involved accidents – with 140 fatalities. Some of the more frequent reasons for bicycle-involved crashes include:
- Distracted drivers
- Aggressive drivers
- Improper lane changes
- Driving too fast for road conditions
- Failing to keep proper lookout
- Failing to yield
Bicycle-involved injuries can often be serious and range from broken bones to brain damage, and even death. For a bicyclist who has been injured, their world can change in an instant. With serious injury and increasing medical bills, it can often be difficult to keep up with everything. Quick FAQs About
Q: Who is responsible for my medical bills or lost wages?A: While the driver who caused the crash is ultimately responsible for the injuries they caused, the answer largely depends on the types of insurance which may be available. For instance, if the driver responsible for the bicycle accident has appropriate insurance to compensate the victim for the injuries sustained, your insurance will initially issue payment for the bills, with you being responsible for the balances. The driver’s insurance normally does not initially pay for medical treatment unless the bicycle victim does not have available Personal Injury Protection (“PIP”) insurance. However, the driver is responsible for the injuries that they caused and we will aggressively pursue your case to help you achieve justice, as well as explore all available insurance coverages which will benefit or assist you.

Q: The other driver says I was at fault but I do not remember the crash, do I have a case?A: Potentially. Determining fault in a bicycle accident, or any crash for that matter takes a review of the evidence. This can often be through examination of the vehicle, bicycle, clothing or of photographs of the incident scene or witness interviews. The evidence may show that you were not at fault, or that you were not completely at fault and therefore, the other driver bears at least some responsibility for your injuries.

I was referred to Justin after I suffered a neck injury in a car accident in 2017. He handled all aspects of my claim with competence and great attention to detail. He was always available to talk and discuss my concerns any time I had questions about my case. Justin worked very hard on my behalf and was able to reach a settlement to the maximum benefits available to me by the at-fault driver’s policy. He is an exceptional attorney. I would recommend him to everyone I know.

Justin is extremely passionate about helping those who are in need. He has been serving the Greater Orlando area for over a decade, not only representing the injured professionally, but also as a community leader and philanthropically. He is honest, transparent and thorough. I highly recommend that anyone who has the misfortune of being injured to seek a discussion with Presser Law.

After I was injured on the job, I was hesitant to get a lawyer involved in the process because I hoped my employer would look out for me. After a few weeks, a friend recommended I reach out to Justin. It was hands down the best decision I made! Justin was always a phone call or text away with any question or concern I had throughout the process, which in the end, was probably the simplest one I've ever been involved in. Justin will always be my go to in the future and will be my personal referral to anyone in Central Florida!

Justin Presser did a great job handling my injury case. He kept me informed throughout the process and was available when I needed him - even outside of business hours! I would highly recommend him to anyone who has been injured and needs an attorney who will be aggressive and who will keep them informed about their case. Thank you again!
