WHO PAYS MY MEDICAL BILLS AFTER A CAR ACCIDENT IF I DO NOT HAVE CAR INSURANCE?It can be unsettling to be injured in a car accident without having any car insurance or health insurance.  “Who pays my medical bills after a car accident if I do not have car insurance” or “how can I afford my treatment if I have no insurance” are common and justifiable concerns. While Florida law requires drivers operating vehicles to carry Personal Injury Protection (“PIP” or “No-Fault”) insurance, it does not require everyone to carry it.  If you do not have a vehicle that you operate on Florida’s roadways, you are not required to carry car insurance.  This would make sense, right?  If you do not own a vehicle, why should you have to carry car insurance? However, one of the benefits of car insurance is that required PIP insurance helps pay for medical bills someone incurs as a result of the crash.  What happens when you are hit by a car and you do not have insurance?  Are you out of luck?  Do you have to pay for your own medical bills?  These are the questions that passengers, pedestrians, or cyclists may ask themselves.

If you were injured as a passenger in a car accident and you do not have car insurance of your own, you may be entitled to utilize someone else’s car insurance. Resident Relative – If you live with a resident relative who has car insurance, you may be entitled to utilize their car insurance to pay for your medical care.  Resident relatives are typically defined as someone you live with and are related to through blood, marriage, or adoption. Host Vehicle – If you have no car insurance and also do not live with a resident relative, you may be entitled to utilize the car insurance which covers the vehicle you were traveling in to pay for your medical care.

If you were struck by a vehicle and injured as a pedestrian and you do not have car insurance of your own, you may be entitled to utilize someone else’s car insurance.
